    Why Deposit Disputes Happen

    The most common cause of deposit disputes in Portugal isn't bad tenants or dishonest landlords. It's ambiguity. When there's no clear record of the property's condition at the start of a tenancy, both sides are left arguing from memory — and memory is unreliable.

    Under Portuguese law, the landlord bears the burden of proof when withholding any part of the deposit. Without documented evidence of damage — photos, timestamps, a signed report — it's extremely difficult to make deductions stick, even when the damage is real.

    The Documentation Gap

    Most property disputes in Portugal stem from a simple documentation gap between check-in and check-out. The check-in report was done on paper — or not at all. Photos were taken on a phone and stored in someone's camera roll. Nobody remembers which scratches were there at the start.

    By the time the tenant leaves, months or years later, that documentation is gone, incomplete or impossible to verify. The agency is stuck in the middle, trying to mediate a dispute with no solid evidence on either side.

    What a Strong Check-In Report Includes

    A professionally documented check-in removes almost all ambiguity. Here's what it needs to include:

    • Room-by-room item assessment: Walls, floors, ceilings, fixtures, appliances — each rated and noted individually.
    • Timestamped photos: Multiple angles per room, with metadata proving when and where they were taken.
    • Meter readings: Energy, gas and water — with photographic confirmation.
    • Inventory list: Furniture, white goods, fixtures — quantities and condition.
    • NIF of all parties: Landlord, tenant and agent — required for any legal process in Portugal.
    • AMI number: Your IMPIC registration, required on all official documents.
    • Signatures: From all parties present, confirming the report's accuracy.

    Why Digital Signatures Change Everything

    A handwritten signature on a paper report can be disputed — "I didn't read it properly", "I signed under pressure", "the copy I received was different." A digital signature captured on the report itself — with the signer's name, their role and the exact date and time — is legally much stronger.

    When a tenant signs the check-in report on the spot, with the photos and the ratings in front of them, and receives their own copy by email minutes later, it's very difficult to later claim they didn't agree to the documented condition.

    Before vs After: The Power of Comparison

    The strongest position in a deposit dispute is a dated photograph from each moment. When the check-in report shows an undamaged wall and the check-out report shows the mark — both timestamped, both signed by the tenant — there is very little left to argue about.

    This is only possible if your check-in photos are stored against the room and the item they show, and the check-in record is still at hand when you do the check-out.
